Cool Pool Terms of Use

Effective Date: April 12, 2026

These Terms of Use (“Terms”) govern your access to and use of the Cool Pool mobile application (“App”), operated by Merenda One LLC (“Company,” “we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility and Permitted Use

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App.

The App is intended solely for:

  • Personal, non-commercial use
  • Pool, spa, and hot tub maintenance, operation, and general education

You agree not to use the App for any commercial, industrial, or business purposes.

2. No Professional Advice

All information provided by the App, including but not limited to:

  • Water chemistry targets
  • Treatment recommendations
  • Calculations and analysis

is provided for general informational purposes only.

You acknowledge:

  • These guidelines may not be appropriate for your specific pool or environment
  • Improper chemical handling can result in property damage, injury, or death

You agree that:

  • You are solely responsible for your actions
  • You will consult a qualified pool professional before making material changes

3. Aqua AI Feature

3.1 General Disclaimer

The App includes an artificial intelligence feature (“Aqua AI”) powered by large language models.

You acknowledge that Aqua AI:

  • May produce inaccurate, incomplete, misleading, or unsafe outputs
  • Does not provide professional, scientific, or safety-certified advice
  • Should never be relied upon as the sole basis for decisions

You are solely responsible for verifying all outputs with a qualified professional.

3.2 Acceptable Use

You may use Aqua AI only:

  • For your own personal pool, spa, or hot tub
  • For non-commercial purposes
  • Through direct, manual interaction within the App

3.3 Prohibited Use

You agree NOT to:

  • Use Aqua AI for unrelated topics or general-purpose AI use
  • Use Aqua AI for commercial purposes or on behalf of others
  • Attempt to reverse engineer, scrape, or extract model outputs
  • Use automated tools, scripts, bots, or APIs to access Aqua AI
  • Circumvent rate limits or security controls
  • Submit images unrelated to pool care
  • Submit images containing:
    • Sexual content
    • Drug use
    • Violence
    • Abuse or exploitation
    • Dangerous or illegal activities
    • Any otherwise inappropriate or offensive material

3.4 Interaction Restrictions

Aqua AI may only be used:

  • By a single human user
  • Through the App interface

Any automated, batch, or programmatic interaction is strictly prohibited.

3.5 Refusal and Filtering

Aqua AI may:

  • Refuse to respond to any prompt
  • Filter or block content it determines to be unsafe, inappropriate, or unrelated

No guarantee is made that responses will be provided.

3.6 Rate Limits and Enforcement

With regards to the Aqua AI feature, we reserve the right to:

  • Apply usage caps, throttling, or rate limits
  • Suspend, restrict, or terminate access at any time

Access may be revoked if, in our sole discretion:

  • You violate these Terms
  • Your usage is excessive, abusive, or harmful

3.7 Availability and Downtime

Aqua AI is provided on an “as available” basis.

You acknowledge:

  • The feature may be unavailable due to maintenance, outages, third-party service disruptions, or other factors
  • Availability is not guaranteed

No refunds, credits, or compensation will be provided for downtime or service interruptions.

3.8 Subscriptions and Billing

  • Aqua AI may require a paid subscription managed through Apple’s App Store
  • Billing, renewals, and cancellations are handled by Apple

You acknowledge:

  • Subscriptions automatically renew unless canceled
  • You are responsible for managing your subscription through your Apple Account

All purchases are final. No refunds will be issued, including for:

  • Incorrect or unexpected AI responses
  • Dissatisfaction with results
  • Service interruptions or downtime
  • Partial usage of a billing period

4. Safety Disclaimer

Pool chemicals and equipment can be hazardous.

Improper use may result in:

  • Chemical burns
  • Toxic exposure
  • Equipment damage
  • Serious injury or death

You agree:

  • To follow all manufacturer instructions and safety guidelines
  • To use appropriate protective equipment
  • Not to rely solely on the App for safety-critical decisions

5. Limitation of Liability

To the maximum extent permitted by law:

Merenda One LLC shall not be liable for any damages, including but not limited to:

  • Property damage
  • Pool or equipment failure
  • Chemical misuse or imbalance
  • Personal injury or death
  • Financial losses
  • Indirect, incidental, or consequential damages

arising from or related to:

  • Use or inability to use the App
  • Reliance on App content or Aqua AI output
  • Errors, omissions, or inaccuracies

Use of the App is at your sole risk.

6. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including:

  • Accuracy
  • Reliability
  • Availability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee:

  • Continuous or uninterrupted operation
  • Error-free functionality
  • Safe or correct outputs

7. Indemnification

You agree to indemnify and hold harmless Merenda One LLC from any claims, damages, liabilities, and expenses arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your handling of pool chemicals or equipment

8. Third-Party Services

The App may rely on third-party services (including AI providers and Apple services).

We are not responsible for:

  • Third-party service availability or performance
  • Data handling by third parties
  • Errors originating from third-party systems

9. Modifications to the App and Terms

We may:

  • Modify, suspend, or discontinue any part of the App at any time
  • Update these Terms at any time

Continued use of the App constitutes acceptance of updated Terms.

10. Termination

We may suspend or terminate your access at any time, without notice, if:

  • You violate these Terms
  • Your use presents risk or liability

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
